At COBELAL BV, we value the privacy and protection of the personal lives of everyone from whom we collect personal data. The purpose of this privacy policy is to inform you about the care we take when handling your personal data and about how we process this data.

1. When does this Privacy Policy apply?

This Privacy Policy applies to the collection and processing of personal data by Cobelal from Belgian John Deere dealers, customers, prospects, suppliers and visitors to this website.

2. Who is responsible for this processing?

COBELAL BV, Division Cofabel, with enterprise number 0408.456.706 and having its registered office at Aarschotsesteenweg 84, 3012 Wilsele (België), is the data controller with regard to the processing as described in this privacy policy.

A data protection officer has been appointed within the group of enterprises to which the data controller belongs, who supervises the protection of your personal data. You may contact this person via privacy@arvesta.eu.

3. What data do we collect from you as a customer or a prospective customer?

3.1 Customers

In this section we explain which customer data we process, why we do this and on what basis. By customers we mean both customers who purchase products and/or services directly from us and the customers of the Belgian John Deere dealers appointed by us.

Which personal data?

We may collect the following data: company name and/or surname and first name, address, VAT number, telephone number, e-mail address, language, company activity, purchasing data (e.g. serial numbers, makes, horsepower ratings, production years, dates of delivery, etc. of machines purchased), history of warranty claims (e.g. previous repairs and interventions), information about your machinery fleet (e.g. types of tractors and other similar machines) and other company data. We may also collect the first names and surnames, e-mail addresses, job titles and telephone numbers of our customers’ contact persons.

The source of the data is as follows:

From you, through sales calls, (order) forms, contracts, invoices, through our website, or through commercial promotions;

Via publicly available data (such as data from your website, from the Belgian Official Gazette, the Crossroads Bank for Enterprises, the National Bank, Graydon and the 1207 information service, etc.;

Through other companies in the Arvesta group, of which Cobelal is a part. A list of these companies can be found at www.arvesta.eu.

Through other companies:

The Belgian John Deere dealers: among other things, for the handling and settlement of warranty requests from customers, for sending our joint direct marketing by e-mail and/or by post and for the follow-up and support of the operation, services and (sales) )activities of the John Deere dealers,...

The John Deere supplier: John Deere Walldorf GmbH & Co KG and its affiliated companies (hereinafter jointly referred to as: “the John Deere Group”): for, among other things, the handling and settlement of warranty applications submitted there, for sending our joint direct marketing by e-mail and by post and for the follow-up and support of our operations, services and (sales) activities.

For what purposes do we process this data?

We use your customer data primarily for the purpose of optimising our business relationship and to ensure that the commitments entered into are fulfilled properly. In concrete terms, this means that we use it to draw up quotations, to fulfil orders, to deliver products and for any correspondence concerning the same, to draw up and send invoices, to track payments, to follow up on warranty terms and to handle warranty claims and repairs. We do this based on our contract with you. Based on our legitimate interest, we also conduct debtor management (following up outstanding invoices, sending reminders, etc.) and maintain a centralised customer and prospective customer administration.

In addition, if you have given permission, we can send you our magazine “De Voor/Le Sillon” by post and/or keep you informed by e-mail about our activities, our products and services, promotions, etc. You have the right to withdraw your consent at any time. You can read how to do this under title 10. We, together with John Deere Walldorf GmbH and the Belgian John Deere dealers, are responsible for these direct marketing activities.

After purchasing a John Deere machine, we can provide you with satisfaction surveys. This helps us, John Deere GmbH and the Belgian John Deere dealers to improve our products and services for the future. As part of the surveys, we ask various questions to check your satisfaction. We conduct such satisfaction surveys on the basis of our legitimate interest. If you no longer wish to receive surveys, you can inform us.

If you wish to participate in demos and/or factory visits, we process your personal data to register you and answer any questions regarding this.

We process your data in order to analyse which products you have purchased and which products/services you may be interested in. We do this so that we can customise our product range as well as our communications with you. We also carry out (statistical) analyses to improve our operations, services, and products. We do this on the basis of our legitimate interest.

Finally, we also process your data in order to fulfil our legal obligations (e.g. storage of invoices, etc.).

For what purposes do we process data from customers of Belgian John Deere dealers:

The follow-up and support of the operation, services and (sales) activities of the John Deere dealers.

How long do we keep your data?

We do not retain the data any longer than is necessary for the realisation of the above purposes. Your data will be deleted as soon as we no longer require it or as soon as there is no legal reason to keep it.

3.2 Prospective customers

This section explains what types of personal data we may process from prospective customers, why we process it and the legal grounds for doing so.

Which personal data?

We may collect the following data: company name and/or surname and first name, telephone number, e-mail address, language, company activity, and information about your machinery fleet (e.g. types of tractors and other similar machines).

We obtain this data from:

You, after you have contacted us via our website, at a trade show, etc.;

Via the Belgian John Deere dealers.

For what purposes do we process your data?

Based on our legitimate interest, we may use your data for sales prospecting purposes, more specifically to contact you, for example, by telephone about those products and/or services which we believe may be of interest to you, because they are complementary to products which you have already purchased from one of the Arvestagroup companies. A list of these companies can be found at www.arvesta.eu. If you do not want us to do this, you can opt out at any time. Section 10 describes how to do this.

How long do we store your data?

We will keep this data only as long as necessary for achieving the aforesaid objectives. Your data will be deleted as soon as we no longer require it or as soon as there is no legal reason to keep it.

4. What personal data do we process about you as a John Deere dealer?

What data?

We process the following data: company name or first and last name, VAT number, address, telephone number, e-mail address, gender, language, purchase history (serial number of purchased machines, brand, horsepower, year of production, date of delivery,...). We may collect the following information from contact persons: first and last name, position, email address and telephone number.

We collect this information directly from you in the context of our importer-dealer relationship. We collect this information when you become a dealer, when you make a purchase, when you contact us, etc.

For what purposes do we process this data?

We use this data for the following purposes for the execution of our agreement with you: administration of your data, managing and executing orders and communicating about them, planning and carrying out deliveries, handling and settling warranty requests, warning of possible recalls, repair requests following up, planning and executing, managing registrations for factory visits and demos, (sales) actions and monitoring general operations and providing support,...

Furthermore, we may also process this data to comply with our legal obligations arising from, among other things, tax and accounting legislation (e.g. storage of invoices, etc.).

We do not keep the data longer than necessary to achieve the above-mentioned purposes. As soon as your data is no longer necessary or no longer legally required to be kept, it will be deleted.

5. Which personal data do we process from you as a supplier?

What data?

We may collect the following data: company name or first and last name, address, e-mail address, telephone number, VAT number, bank account number, sales data and information about your professional activities. We can collect the name, position, telephone number and email address of the contact persons at suppliers.

We obtained this information:

From yourself, through sales conversations, quotes, contracts, invoices,...

Via publicly available data (such as data from the Belgian Official Gazette, the Crossroads Bank for Enterprises, the National Bank, Graydon and the intelligence service 1207,...;

Through other companies of the Arvesta group, of which we are also a part. You can read which companies these are at www.arvesta.eu.

For what purposes do we process this data?

Your data will primarily be used to ensure that the business relationship between us runs optimally and to correctly implement and monitor the commitments made. In concrete terms, we use your data for, among other things, keeping supplier administration, preparing and sending orders, processing and paying incoming invoices and communicating about this. We carry out this processing because it is necessary for the execution of our agreement with you.

Secondly, we may also process your data to comply with our legal obligations, which may arise, among other things, from tax and accounting legislation.

As soon as your data is no longer necessary or no longer legally required to be kept, it will be deleted.

6. Which data do we collect via our website?

This section explains what types of personal data we may process via the website, why we process it and the legal grounds for doing so. In addition, we also state how long we store this data.

Contact form

You can contact us via our website using the online contact form. If you do so, we will collect details of your first name, surname, e-mail address and the question you have asked or any other comment. We have a legitimate interest in collecting the information you provide, so we can respond to your message. We will not store this data for any longer than necessary to answer your questions or provide you with the requested information.

Newsletters

You can register to receive e-mails with information about our products, our events, tips, advice, etc. through the website. To subscribe to the newsletter, we collect your e-mail address and the language in which you want to receive the newsletters. Newsletters are only sent after obtaining your consent.

You can notify us at any time that you no longer wish to receive such newsletters. Section 10 describes how to do this.

Events

We regularly organise events, and you can register for the same via the website. By default, we collect your first name, surname and your e-mail address for such registration. We use this information to process your registration for the event, to confirm your registration, to inform you about the event and, if necessary, to answer any questions you may have. Your data will be deleted as soon as it is no longer required for the above purposes.

7. Do we share or sell your data?

In the context of our activities and for the fulfilment of our service provision, we may share your data with the following:

Service providers who are commissioned by us to process your personal data on our behalf (such as, data centres, providers of administrative services, IT service providers, printers, mailing houses, website builders, etc.). We have concluded agreements with these parties to ensure the protection of your data.

The companies of the Arvesta group, to which we also belong. A list of these companies can be found at https://arvesta.eu. We do this to centralise our customer and supplier administration and for prospecting purposes. With regard to the latter, these companies may use your data for prospecting purposes and to contact you about those products and/or services which they and/or we believe may be of interest to you, e.g. because they are complementary to products/services you already purchase from us. They may contact you about this. You have the right, at any time, to opt out of this sharing of your data and its use by one or more of our group companies. Section 7 describes how to do this.

The Belgian John Deere dealers and our supplier John Deere Walldorf International GmBh and its affiliated companies:

On the one hand, in the context of handling and settling warranty claims from our customers and the customeers of the Belgian John Deere dealers and in the context of supporting and monitoring our operations and sales (activities). Cobelal, John Deere Walldorf International Gmbh and the John Deere dealers are separately responsible for these data processing operations. On the other hand, in the context of our joint direct marketing activities, for which we, subject to your consent, keep you informed by mail and/or e-mail about our activities, products, services, promotions... We are jointly responsible for this use together with John Deere International Walldorf and the Belgian John Deere dealers.

Government and government agencies: to comply with our legal obligations. We only share the data that we are legally required to share.

In the context of a merger, acquisition, (partial) divestiture or any other corporate transaction, we may also share your data with and transfer it to the third party (e.g. acquirer, absorbing company, etc.) involved in such corporate transaction. We may also share your data with the relevant third party and/or their advisers as part of an investigation into the execution of such a transaction. In such case, we shall always ensure that we only transfer the data that is relevant and necessary for the investigation. We make these transfers based on the legitimate interest that the third party can use the obtained data to continue the business activities and general operation of the company. Furthermore, the latter also allows for the continuation of current agreements with customers, suppliers, etc.

In conclusion, under exceptional circumstances, disputes and other incidents can also lead to your personal data being shared with the police and other judicial bodies. Law firms, debt collection agencies, bailiffs, insurance companies or banks, among others, will also be able to gain access to some of your personal data when it is necessary for them to assist us in handling a file, or to execute projects, etc.

8. Transfer of data outside the European Economic Area

In the context of the transfer of your data as described in Section 7, it is possible that your data could be transferred to a party located outside the European Economic Area (hereinafter "EEA"). This is the case, for example, in relation to the transfer of your data to John Deere GmbH, which in turn may transfer data to its affiliated companies, which may be located outside the EEA (such as in the United States of America).

In that case, we guarantee that these parties apply an adequate level of data protection prior to the transfer (e.g. by verifying that the European Commission has ruled that the country in question has an adequate level of data protection or by including the so-called EU model contractual clauses of the European Union in the agreement with such parties).

9. How do we secure your personal data?

We will take all the necessary steps to ensure protection of your personal data, physically, electronically as well as at the organisational level.

For example, we store the personal data provided by you in databases, information systems and servers that are only accessible to authorised personnel or contractors who need to have this data in order to process it for us. In addition, our personnel are notified of this privacy policy and of all the applicable internal guidelines that were issued for the protection of your personal data. They are also obliged to respect the confidentiality of your personal data.

10. How can you contact us to exercise your rights?

You have the right to demand inspection of your personal data free of charge at any time. You also have the right to delete or rectify incorrect, invalid, outdated, or incomplete personal data. You also have the right, in certain cases, to request us to cease the use of your personal data for a specific type of processing. Finally, you have the right to object to any specific type of processing of your personal data.

If you no longer wish to receive newsletters or mail personally addressed to you, including information about our activities, products and services, promotions, etc., you may opt out at any time. If you no longer wish to receive newsletters, you may unsubscribe via the unsubscribe link at the bottom of the e-mails. You may also contact us at any time, using the contact details below, to unsubscribe from e-mails as well as from personally addressed mail.

You should send your request by email to privacy@arvesta.eu or by post to the address mentioned under section 1.

Such requests must contain the following information: full name, address, e-mail address and a clear description of your request. Additional information may be requested in order to better define the subject of your request or to confirm your identity in case of reasonable doubt.

We shall have one month’s time to reply to your request. Take into account the fact that this period only begins when we receive your dated and signed written request by post, electronically or in writing at our offices and when we have received all the information required in order to fulfil your request.

If, in your opinion, we have not handled your request appropriately, please contact us using the contact information above. If this does not produce the desired result, you have the right to file a complaint with the supervisory authority in the country in which you are residing. For Belgian customers, this is the Belgian Data Protection Authority [de Belgische Gegevensbeschermingsautoriteit].

11. Amendments to this Policy

If we make any changes to this Privacy Policy, the amended Policy will be published here with a statement of the date of revision at the top. If we make any significant amendments to this Privacy Policy that substantially alter our privacy practices, we may also notify you of the same by different means, e.g. by sending you an email or by publishing a statement on our website before the changes come into effect.
